A young boy with significant mental health conditions was entrusted to a residential facility for the specialized care he required.
The care plan agreed upon by the facility explicitly called for 24-hour supervision by a trained residential counselor.
The facility, however, was understaffed, had insufficient training, and implemented improper policies.
This led to a devastating breakdown of the young boy’s care plan.
The boy was left unsupervised and wandered into a secluded area, where another resident assaulted him.

Despite his inability to communicate verbally, we proved through expert testimony that the boy suffered severe post-traumatic stress disorder (PTSD) as a result of the attack.
His non-verbal condition did not shield him from the trauma, and he required a higher level of care to manage the impact of his PTSD.
