Frequently Asked Questions

What constitutes medical malpractice?

Medical malpractice or professional negligence consists of negligent carelessness or unskilled performance by a physician on the duties imposed on him or her by the professional relationship with you, the patient.

In other words, if the physician did not use the proper care and skill in the performance of a professional act, that physician was negligent.

What is negligence?

Negligence is simply the failure to use ordinary care in the same or similar circumstances.

How do I prove that the doctor’s mistake caused me damages?

There are two types of ways that a doctor or hospital’s negligence causes damages under the law.

  1. Factual Causation: the direct connection between the conduct and the harm which lead to the damages.
  2. Proximate Causation: the underlying cause of the harm which lead to damages.

Factual cause is simple in your injury would not have occured “but for” the negligence of the medical professional, like using the wrong instrument or prescribing the wrong medication.

Proximate cause is usually applicable when the doctor fails or delays to act, which increases your risk of harm. Examples are failing to diagnose a particular condition that, if it had been diagnosed more timely, you would have had a better recovery.
