You don’t know what you don’t ask.
We represented a young girl in a serious T-bone motor vehicle collision.
She had sustained significant injuries, including herniations to her lower back, which required surgery.
We conducted our routine follow-ups via phone and Zoom calls, during which she did not mention anything that raised our concerns.
So, we were shocked when she showed up at a mediation session seven-and-a-half months pregnant.
She had not even told her surgeon that she was pregnant during her post-op appointments.
The defense, of course, argued that all of her back pain was related to the pregnancy.
Despite this surprise, we resolved the case at the second round of mediation.
However, the case served as a reminder that we need to ask specific questions when following up with our clients regarding significant changes in their health.
If you or a loved one has been injured due to someone else’s negligence, it’s time to take a stand.
