Picking a jury versus selecting a jury

Jury selection is more of an art than a science.

In most counties, we get a pool of jurors, each side strikes jurors from the Panel, and the jury is selected from the remaining pool.

So, in reality, instead of “picking” the jury, we are removing jurors until we are left with 8 or 12 jurors.

Recently, however, we had a judge try something we’ve never seen before: each side could “pick” the jurors that they wanted for the 12-person jury.

This certainly led to a different experience because we had more control over the process.

Of course, that also means the defendants had more control over the process on their side.
