The trial had been going on for eight days when the defendant’s life care planner took the stand.
Mary’s doctors failed to diagnose her breast cancer, and because of that, her life would be cut short by 14 to 15 years. Along with that came over a million dollars in medical, future medical expenses, and household needs.
Mary and her wife, Paula, had been together for 30 years and married for 10. Paula sat next to Mary the entire trial, holding hands and staying strong for Mary throughout. Paula testified a few days before, and the jury clearly identified with her and felt her pain.
In stark contrast to our life care plan, the defendants’ Life Care Planner testified that Mary and Paula’s future expenses would only be about $75,000 a year.
On cross-examination, I noted the substantial difference between the two plans and asked, “How do you think Paula feels about that?”
After an uncomfortable silence, the Life Care Planner looked at me and said, “Who’s Paula?”
Most of the jurors just shook their heads in disbelief.
I didn’t have to ask any more questions and sat down.
