Most of us enjoy a good tailgate and have come to know what that game day fever is all about – great food, drinks, and being outdoors before a good game.  

In a construction injury case, however, we learned that tailgating can mean something entirely different.

A key aspect of the case involved whether the construction company’s manager discussed that day’s construction plan with our client, Anthony.  

We said they did meet, and the construction manager said they did not. In fact, Anthony remembered that they met “at the tailgate meeting,” which is a familiar term at the construction site. 

Discovery in the case revealed video footage of the job site on the morning in question, and, lo and behold, there was the construction manager and Anthony pouring over the construction plans laid out on the rear tailgate bed of a pickup truck. 

The case settled after depositions confirmed it all.  

“Meet me at the tailgate” has a new meaning.
